Understanding our refund terms and conditions for our IT services

This Refund Policy outlines the terms and conditions for refunds on services and products provided by Orgtata, a specialized IT wing of TATA MOTORS LIMITED. We are committed to fair and transparent business practices and strive to ensure your satisfaction with our services.

1. General Refund Policy

At Orgtata, we evaluate refund requests on a case-by-case basis. Our refund policy varies based on the type of service or product provided:

1.1 Consulting Services

For consulting services, refunds may be issued if the service has not yet been performed or if we were unable to deliver the agreed-upon service. Once consulting services have been delivered, refunds are generally not provided as these services consume time and resources that cannot be recovered.

1.2 Software Development and Implementation

For custom software development and implementation projects:

  • If the project is canceled before development begins, a refund may be provided after deducting costs associated with planning and requirements gathering.
  • For projects in progress, refunds are limited to the portion of work not yet completed, less any costs already incurred.
  • For completed projects, refunds are not provided unless the deliverables fundamentally fail to meet the agreed-upon specifications.

1.3 Subscription Services

For ongoing subscription-based services:

  • Monthly subscriptions: You may cancel at any time, but refunds are not provided for the current billing period.
  • Annual or prepaid subscriptions: A prorated refund may be issued for the unused portion if canceled within 30 days of payment. After 30 days, refunds are at the discretion of Orgtata management.

1.4 Hardware Products

For physical products or hardware sold by Orgtata:

  • Unopened products in original packaging may be returned within 14 days of receipt for a full refund.
  • Opened products may be returned within 7 days if defective, for either replacement or refund.
  • Custom-ordered or specially configured hardware is non-refundable unless defective.

2. Refund Process

To request a refund, please follow these steps:

  1. Contact our customer service team at refunds@orgtata.shop with your order details and reason for the refund request.
  2. Include your name, order or invoice number, date of purchase, and any relevant documentation supporting your refund request.
  3. Our team will review your request and respond within 5 business days.
  4. If approved, refunds will be processed within 7-10 business days to the original payment method.

Note that payment processing fees may be deducted from refund amounts in certain cases.

3. Non-Refundable Items and Services

The following items and services are generally not eligible for refunds:

  • Services that have been fully delivered according to specifications
  • Custom development work that has been completed
  • Setup, installation, or configuration services that have been performed
  • Training sessions that have been conducted
  • Software licenses that have been activated or used
  • Products or services explicitly marked as non-refundable at the time of purchase
  • Purchases made more than 30 days prior (except where specified otherwise)

4. Service Level Agreement (SLA) Refunds

For services covered by a Service Level Agreement (SLA), refunds or service credits may be available if we fail to meet the agreed-upon service levels. Please refer to your specific SLA for details on:

  • Conditions under which service credits or refunds are applicable
  • Method of calculating service credits or refund amounts
  • Process for claiming SLA-related refunds

SLA refunds or credits are typically limited to a percentage of the fees paid for the affected service during the relevant period.

5. Cancellation Policy

For project-based services:

  • Cancellation before work begins: Full refund less a 10% administrative fee
  • Cancellation after work begins: Refund for uncompleted work less costs incurred and a 15% administrative fee

For scheduled services (training, consultations, etc.):

  • Cancellation more than 7 days before scheduled date: Full refund
  • Cancellation 3-7 days before scheduled date: 50% refund
  • Cancellation less than 3 days before scheduled date: No refund

6. Exceptions

We understand that exceptional circumstances can arise. Orgtata management reserves the right to make exceptions to this policy on a case-by-case basis. Factors that may be considered include:

  • Customer relationship history
  • Circumstances beyond the customer's control
  • Technical issues on our part that impacted service delivery
  • Other relevant factors specific to the situation
